The regular meeting of the Morris Planning Commission was called to order at 5:15 p.m. this 16th day of August, 2011, by Chairperson Kuchenreuther in the Council Chambers of the Morris Senior Citizens/Community Center.

CALL OF THE ROLL:  Roll call was taken with the following members present:  Commissioners Johnson, Granger, Livingston, Gades and Chairperson Kuchenreuther.  Commissioners Rudney and Hoffman were absent.  Also present were ex-officio Miller and City Manager/Zoning Administrator Hill.

READING AND APPROVAL OF 6/21/11 REGULAR MEETING MINUTES:  Commissioner Granger moved, seconded by Johnson, to approve the minutes of the regular meeting held 6/21/11.  Motion carried.


OTHER BUSINESS:  September Zoning Hearing:  Notice will go out to every property owner in the City.  Hill indicated he does not anticipate that a lot of people will show up at the hearing.  The public notice will state the areas where zoning will change, and Hill hopes most people will call with questions ahead of time.

Livingston asked how Iowa Avenue and 7th Street will be zoned.  Hill indicated it is proposed that area be RM (Multiple Family Residence District). 

Kuchenreuther pointed out there are two different definitions of the RM district in the notice.  Hill will correct that.  Kuchenreuther also suggested that the word �if� in the 2nd sentence in the 2nd to last paragraph of the notice be changed to �whether�. 

Hill indicated the bullets in the notice will be changed to numbers.  Miller suggested numbering the changes on the proposed zoning map to coincide with the numbers in the notice.

The fourth bullet reads, �Change all Morris Public School Property near the University to Residential (R) and all University property to Municipal Conservancy (MC).�  It was the consensus to strike �and all University property to Municipal Conservancy (MC)�. 

Hill noted a couple of language changes in the Code are also proposed, one being that the Fairgrounds be zoned Highway Business and be added as a permitted use. 

There are several references to zoning lines being 600� deep in the notice.  Hill noted the 600� is measured from the property line.  Kuchenreuther indicated �from the property line� should be added after the 600� measurements listed in the notice.

Granger asked how the Planning Commission would answer a question regarding a zoning change affecting the value of a person�s property.  Hill indicated his philosophy is that a property is grandfathered in until it is no longer usable.  Kuchenreuther read Section 11.10, Subd. 2B, �A non-conforming use of a structure which has been discontinued for a period of twelve (12) months shall not be re-established and any further use shall be in conformity with the regulations of this Chapter.�  Hill indicated he does not feel there are many cases where that will happen. 

Variance Request:  Hill indicated there will be a variance request at the September meeting to construct a rambler on a corner lot.  The variances needed will be for lot coverage and sideyard setback.  Kuchenreuther indicated it bothers her that story and a half neighborhoods are being changed to rambler neighborhoods.  Ex-officio Miller indicated he feels the Riverview house for which a variance was granted last year looks very nice.

ADJOURNMENT:  Commissioner Gades moved, seconded by Livingston, to adjourn.  Motion carried and the meeting adjourned at 6:10.
