The regular meeting of the Morris City Council was called to order at 5:15 p.m. this 9th day of January, 2018, by Mayor Giese in the Council Chambers of the Morris Senior Citizens/ Community Center.

PLEDGE OF ALLEGIANCE:  The Pledge of Allegiance was recited.

ROLL CALL:  Roll call was taken with the following members present:  Council member Wohlers, Gullickson, Miller and Mayor Giese.  Council member Solvie was absent.  Also present was City Manager Hill, Finance Director Raasch, Public Works Director Dittbenner and City Attorney Jordan.   

ADDITIONS TO AGENDA:  Mayor Giese added two Temporary Liquor License Applications to the agenda under the Consent Agenda.

OFFICIAL ACTSElection of Mayor Pro Tem:  Council member Miller moved, seconded by Wohlers, to elect Council member Solvie as Mayor Pro Tem for 2018.  Motion carried.

Appointments to Boards and Commissions:  Mayor Giese moved, seconded by Miller, to appoint the list of people as presented to the various boards and commissions.  Motion carried.

Appointment of Ex-Officios:  Mayor Giese moved, seconded by Gullickson, to appoint Giese to the West Central Initiative Board as Council member Miller's 2nd three-year term is up.  Motion carried.  All other appointments shall remain the same.

Designation of Official Newspaper:  Mayor Giese moved, seconded by Council member Wohlers, to designate the Stevens County Times as the official newspaper of the Morris City Council.  Motion carried.



READING AND APPROVAL OF MINUTES12/26/17 Regular Meeting Minutes:  Council member Wohlers moved, seconded by Gullickson, to approve the 12/26/17 regular meeting minutes.  Motion carried.

12/26/17 Condensed Version Minutes:  Council member Gullickson moved, seconded by Miller, to approve the 12/26/17 condensed version minutes.  Motion carried.

CONSENT AGENDA:   Mayor Giese moved, seconded by Council member Miller, to approve the consent agenda which included the following items:

         A.      Audit of City Bills

         B.      December Transit Report

         C.      Temporary On-Sale Liquor License - FOE Aerie #620 for 1/20/18

         D.      Temporary On-Sale Liquor License - American Legion for 1/3/18

Motion carried.

PETITIONS, REQUESTS AND COMMUNICATIONSAccept Donation to Fire Department: Council member Miller moved, seconded by Gullickson, to accept the donation of $500 from West Central Christian Homes to the Fire Department.  Motion carried.

ORDINANCES AND RESOLUTIONSResolution Adopting the 2018 Morris City Council Standing Rules:   Council member Wohlers moved, seconded by Gullickson, to adopt Resolution #3539-1-18, Resolution Adopting the 2018 Morris City Council Standing Rules.  Upon a roll call vote taken and all present voting in favor, motion carried.

There was discussion about having a 4/5 vote of the council to add an item to the agenda as is stated in the rules.  The council would follow through with that from now on instead of just having Mayor Giese add an item to the agenda.

First Reading of Ordinance No. 108:  Hill explained that the Human Rights Commission and Rental Housing Commission have not met for a long time.  Hill noted the rental commission was established when the rental housing issue came up with the University, but there is a separate ordinance that deals with the licensing program.  Hill indicated the HRC is a strange one for a city the size of Morris.  Hill explained there was a reason it got set up but the bottom line is that they haven't been meeting and there are no issues to be discussed.  Hill added that if an issue arises it can be sent to the council or the state human rights commission. 

The code also refers to the Morris HRA, which has now been merged to become the Stevens County HRA so that language will be updated.  This ordinance would also include setting up the City Council as the appeals board for the rental licensing program. 

Council member Wohlers moved, seconded by Mayor Giese, to accept this as the first reading of Ordinance No. 108, An Ordinance Repealing City Code Sections 2.55, Housing and Redevelopment Authority, 2.60, Human Rights Commission and 2.62, Rental Housing Commission, and Amending City Code Section 4.32, Residential Rental Property Registration and Licensing, setting the public hearing for 5:20 p.m. on January 23, 2018.  With all voting in favor, motion carried.

CITY MANAGER'S REPORTS & RECOMMENDATIONS:   City Manager Report:  This was informational for the council. 

OTHER BUSINESSSchedule Meeting for Closed Door Session:  City Attorney Jordan asked what the nature of the meeting was.  Hill indicated the meeting is being held to talk about union negotiations before the upcoming mediation.  Jordan advised that as the last thing on the next agenda the council cite the statute that allows for a closed meeting.  Jordan explained that the statute requires that it be stated what the meeting is being closed for before the session is actually closed.  Jordan added that the meeting also needs to be recorded.  It was the consensus of the council to hold the closed door session after the next council meeting on January 23rd.
