MINUTES – MORRIS CITY COUNCIL – REGULAR MEETING – NOVEMBER 25, 2014

The Regular Meeting of the Morris City Council was called to order at 5:15 p.m. this 25th day of November, 2014, by Mayor Giese in the Council Chambers of the Morris Senior Citizens/Community Center.

PLEDGE OF ALLEGIANCE:  The Pledge of Allegiance was recited.

ROLL CALL:  Roll call was taken with the following members present:  Council members Wohlers, Solvie, Miller, Storck and Mayor Giese.  Also present were City Manager Hill, City Attorney Jordan, Finance Director Raasch, Fire Chief Dybdal, Chief of Police Tiegs and Public Works Director Dittbenner.  Engineering Surveyor/Inspector Fier arrived at 5:25.

AGENDA ADDITIONS:  Mayor Giese added two items to the agenda:  The first item being “D” under the Consent Agenda - Pay Estimate #3 to Par Piping and Fabrication for the DENCO project; and the second item being “B” under Ordinances and Resolutions – Resolution Authorizing a Request for an Advance on Municipal State Aid Street Funds.

CITIZEN’S COMMENTS:  None.

PUBLIC HEARINGS:  Public Hearing and 2nd Reading of Ordinance No, 98, An Ordinance Amending the City of Morris Zoning Map and Amending the HB District to Allow an Additional Conditional Use:  Mayor Giese opened the public hearing at 5:20.  City Manager/Zoning Administrator Hill explained this hearing is on a request to change the current zoning at the West Central Implement site at 1100 Atlantic Avenue from I1 (light industrial) to partially HB (highway business) and partially R (residential) between Oregon Avenue and Columbia on East 10th Street, along with adding online auction collection sites as a conditional use in the HB (Highway Business) zone.  

The Planning Commission held a public hearing on this request, and during that hearing, Co-op Manager Brian Kruize made a request to not have their property split between HB and R.  Another resident suggested that leaving it I1 would probably mean less activity at night.  There were no public comments, and the hearing was closed at 5:25.

Council member Wohlers moved, seconded by Storck, to adopt Ordinance #98, An Ordinance Amending the City of Morris Zoning Map and Amending the Highway Business (HB) District to Allow an Additional Conditional Use.  Upon a roll call vote taken, motion carried unanimously.

Public Hearing and 2nd Reading of Ordinance No. 100, An Ordinance Amending the City of Morris Zoning Code to Allow Three Story Buildings in the HB District:  Mayor Giese opened the public hearing at 5:25 p.m.  City Manager Hill explained the Fire Department is able to handle fires on 3-story buildings with the ladder truck.  There were no public comments, and the hearing was closed at 5:26.

Council member Storck moved, seconded by Miller, to adopt Ordinance #100, An Ordinance Amending the City of Morris Zoning Code to Allow Three (3) Story Buildings In a Highway Business (HB) District.  Upon a roll call vote taken, motion carried unanimously.

READING AND APPROVAL OF MINUTES:  11/10/14 Regular Meeting Minutes:  Council member Miller moved, seconded by Wohlers, to approve the 11/10/14 regular meeting minutes.  Motion carried unanimously.

11/10/14 Condensed Version Minutes:  Council member Solvie moved, seconded by Wohlers, to approve the 11/10/14 condensed version minutes.  Motion carried unanimously.

11/10/14 Canvassing Meeting Minutes:  Council member Wohlers moved, seconded by Miller, to approve the minutes of the 11/10/14 canvassing meeting.  Motion carried unanimously.

CONSENT AGENDA:  Mayor Giese moved, seconded by Council member Miller, to approve the consent agenda which included the following items:

Audit of City Bills

Revenue and Expenditure Report

Temporary Liquor Application – American Legion

Pay Estimate #3 – Par Piping and Fabrication – DENCO Project - $321,4316.78

Motion carried.

PETITIONS, REQUESTS AND COMMUNICATIONS:  Gambling Report from American Legion:  Council member Miller moved, seconded by Storck, to approve the gambling report from the American Legion for the month of September.  Upon a roll call vote taken and Council members Wohlers, Solvie, Storck and Miller voting in favor and Mayor Giese abstaining as an officer of the Legion, motion carried.

ORDINANCES AND RESOLUTIONS:  First Reading of Ordinance No. 101, An Ordinance Amending the CBD to Add An Additional Conditional Use:  City Manager Hill explained that Jeff and Kathy Wilcox, who own Wilco Precision, Inc., have sold their building in the Industrial Park and purchased the old Kieffer Electric building at the corner of 5th and Oregon.  They are not yet operating out of that building, but have asked the Planning Commission to consider adding precision machining shops to the list of conditional uses in the Central Business District (CBD).  Presently the City Code does not address this type of business.  Hill indicated the Planning Commission will hold a public hearing on this request at their December meeting.  Hill is recommending the City Council hold the first reading of Ordinance #101, An Ordinance Amending the Central Business District (CBD) to Add An Additional Conditional Use tonight, and then set the 2nd reading and public hearing for the Council’s last meeting in December.

Hill indicated he feels this is a pretty good use for that building.  He indicated he will also be recommending to the Planning Commission that this use be added to the HB zone.  

Mayor Giese moved, seconded by Solvie, that this be the 1st reading of Ordinance #101, and the 2nd reading and public hearing be set for 12/23/14 at 5:20 p.m.  Upon a roll call vote, motion carried unanimously.

Resolution Authorizing A Request for an Advance on Municipal State Aid Street Funds:  Hill explained the City can apply for an advance on Municipal State Aid Funds, and this resolution authorizes the request.  These funds would be used for the upcoming Oregon Avenue and Atlantic Avenue projects.

Council member Miller moved, seconded by Storck, to adopt Resolution #3269-11-14 A Resolution Authorizing a Request for an Advance on Municipal State Aid Street Funds.  Upon a roll call vote taken, motion carried unanimously.
