MINUTES – MORRIS CITY COUNCIL REGULAR MEETING – JULY 10, 2012

The regular meeting of the Morris City Council was called to order at 5:15 p.m. this 10th day of July, 2012, by Mayor Giese in the Council Chambers of the Morris Senior Citizens/Community Center.

PLEDGE OF ALLEGIANCE:  The Pledge of Allegiance was recited.

ROLL CALL:  Roll call was taken with the following members present:  Council member Webster, Miller, Storck and Mayor Giese.  Also present was City Manager Hill, Finance Director Krosschell, Accountant Deb Raasch and Public Works Director Dittbenner. Council member Carrington arrived at 5:20 p.m.   City Attorney Jordan arrived at 5:46 p.m.

PUBLIC HEARINGS:  None

READING AND APPROVAL OF MINUTES:  6/26/12 Regular Meeting Minutes:  Council member Storck moved, seconded by Webster, to approve the 6/26/12 regular meeting minutes.  Motion carried.

6/26/12 Condensed Version Minutes:  Mayor Giese moved, seconded by Council member Storck, to approve the 6/26/12 condensed version minutes.  Motion carried.

CONSENT AGENDA:  Council member Miller moved, seconded by Webster, to approve the consent agenda which included the following items:

         A.      Audit of City Bills

         B.      Pay Estimate #1 – East 2nd Street

         C.      Pay Estimate – Pacific Avenue (Arch Pipe)

         D.      Pay Estimate – F & S Concrete (Fire Hall)

         E.       June Transit Report

         F.       Gambling Report

Motion carried.

PETITIONS, REQUESTS AND COMMUNICATIONS:  None

ORDINANCES AND RESOLUTIONSResolution Declaring a Vacancy in a City Council Position:  This resolution would declare a vacancy on the council due to the resignation of Twig Webster, as of July 31, 2012.  City Manager Hill stated once the council takes action to declare the vacancy, the council has 30 days to appoint an eligible replacement. 

Council member Miller felt it would make sense to appoint someone that signs up to run in the November election.  Miller stated he would like to see someone on the council who wants to be there and cares about the community.  Hill stated whoever the council decides on would be appointed until the next election which, is November 6th.  Mayor Giese noted he would rather not appoint someone who is going to run, because he felt it was like prescreening the candidates. 

Considerable discussion was held on when to declare the vacancy and whether or not it should be filled with someone who files for the election.

Mayor Giese indicated he would like to make a decision at the next council meeting.  Hill encouraged those interested to write a letter to the Mayor indicating their interest in the position.  Mayor Giese has a letter from one interested individual at this point.

Council member Miller moved, seconded by Mayor Giese, to adopt Resolution #3086-7-12, Resolution Declaring a Vacancy in a City Council Position.  Upon a roll call vote taken and all present voting in favor, motion carried.

Resolution Authorizing the Publication of an EAW for the Old Elementary School:  Hill explained the format is laid out by the state of Minnesota for the steps needed prior to demolition of the old elementary school.  Publication of the Environmental Assessment Worksheet in the Quality Board Monitor is a mandatory requirement when demolishing a building on the National Historic Registry.  There are no follow up plans at this point, this is strictly for the demolition of the school.

Hill explained the EAW will be published, a copy put on the cityís website and then mailed to approximately 27 different state agencies.  Hill noted after the 30 day comment period ends he would be bringing another resolution to the council. 

Council member Miller moved, seconded by Storck to adopt Resolution #3087-7-12, Resolution Authorizing the Publication of an EAW for the Old Elementary School.  Upon a roll call vote taken and all present voting in favor and Council member Carrington abstaining, motion carried. 

Resolution Appointing Judges for the State Primary Election August 14, 2012:  Hill indicated it is getting very hard to find election judges.  This is something that will have to be looked at long term.  Hill stated Deputy Clerk Anderson does a very good job of finding people, but the city needs a lot more people to start doing it. 

Mayor Giese moved, seconded by Council member Carrington, to adopt Resolution #3088-7-12, Resolution Appointing Judges for the State Primary Election August 14, 2012.  Upon a roll call vote taken and all present voting in favor, motion carried.

CITY MANAGERíS REPORTS & RECOMMENDATIONSCity Manager Report:  This was informational for the council. 

Council member Carrington left the meeting at 5:50 p.m.

NEW BUSINESS:   Mayor Giese moved, seconded by Council member Webster, to change the date of the first meeting in August to August 7th at 5:15 p.m. due to the primary election.  Motion carried.

OLD BUSINESS:  None

INFORMATIONAL ITEMS:  None

ADJOURNMENT:  There being no further business, Mayor Giese adjourned the meeting at 5:54 p.m.
