MINUTES – MORRIS CITY COUNCIL – REGULAR MEETING
AUGUST 11, 2009
The regular meeting of the
Morris City Council was called to order at 5:15 p.m. this 11TH day
of August, 2009, by Mayor Giese in the Council Chambers of the Morris Senior
Citizens/Community Center.
PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was recited.
ROLL CALL: Roll
call was taken with the following members present: Council member Carrington,
Webster, Miller and Mayor Giese. Council member Storck was absent. Also
present was Finance Director Krosschell, Police Chief Beauregard and City
Attorney Glasrud.
ADDITIONS TO AGENDA:
Mayor Giese added two items to the agenda under Petitions, Requests and
Communications: 1)Cost share agreement with USDA for rain garden at PDT Park;
2)Application for On Sale Liquor License from American Legion.
CITIZEN’S COMMENTS:
Jim Dieter was present at the meeting as a member of the Tri-County Horseshoe
League. Dieter indicated the league was utilizing the horseshoe pits at East
Side Park before they were removed, but admitted their league had not been very
proactive in maintaining the pits. Dieter stated the league hoped that more
pits could be placed in one of the parks in town or PDT. Dieter noted his son
is looking for an Eagle Scout project and would be interested in helping to
build some new pits.
Webster stated it wasn’t
the Park Board’s intention to get rid of horseshoe pits entirely. Miller
indicated it is the intent to have the pits remain somewhere in one of the
parks. Webster suggested working with the Park Board because they would love
the help for some new pits. Dieter indicated he would attend the next Park
Board meeting to discuss their ideas.

READING AND APPROVAL OF
MINUTES: 7/28/09 Regular Meeting Minutes: Council member Miller
moved, seconded by Webster, to approve the 7/28/09 regular meeting minutes.
Motion carried.

Version Minutes: Council member Webster moved seconded by Mayor Giese, to
approve the 7/28/09 condensed version minutes. Motion carried.
CONSENT AGENDA:
Council member Webster moved, seconded by Mayor Giese, to approve the consent
agenda, which included the following items:
A.
Approval of the city bills
dated August 11, 2009
B. July
Transit Report
C. Street
Dance Permit Request
With regard to the street dance, Police Chief Beauregard
stated the dance is being held in conjunction with a softball tournament in
town. Beauregard stated there would also be camping at the armory but he has
talked with everyone involved and has no problems with the events.
PETITIONS, REQUESTS AND
COMMUNICATIONS: State Cost-Share Agreement for Rain Garden at PDT Park:
Council member Miller moved, seconded by Carrington, to approve the cost share
agreement with the USDA for the rain garden at PDT park. Motion carried.
Application for an On
Sale Liquor License Application: Council member Carrington moved, seconded
by Miller, to approve the application for an on sale liquor license for the
American Legion for the beer gardens at the Stevens County Fair, August 12th
through the 16th. Upon a roll call vote taken and all present
voting in favor and Mayor Giese abstaining as an officer of the Legion. Motion
carried.

RESOLUTIONS: None
CITY MANAGER’S REPORTS
& RECOMMENDATIONS: City Manager Report: This was informational
for the council. Council member Miller stated he drove through Highland Homes
Addition and thought everything looked very good. With regard to the property
owner who was upset about a portion of the project, Webster indicated he could
understand her frustration because she probably had a picture in her mind about
how it should look.
NEW BUSINESS: None
OLD BUSINESS:
Webster informed the council he received a complaint from a homeowner on
Eleanor Avenue that has long standing problems with a neighbor who has a dog
kennel and shed right on the property line with no 5’ setback. Webster
explained when the kennel is cleaned out the waste washes downhill into the neighbor’s
yard and has killed grass over the years. Also, anytime utility work is done,
the utility companies have to drive across the neighbor’s yard because the
kennel and shed are on the easement.
City Attorney Glasrud indicated
there may be some zoning trouble because these are not permanent structures.
It could also be a trespass of sorts when stuff is cast onto a neighbor’s land.
Glasrud asked if this was a function of local government or if people should be
dealing with these types of problems themselves. Webster stated this has been
a long standing issue and neighborly contact has not resolved the matter.
Police Chief Beauregard indicated this would be a matter for the building
inspector to look into.
Webster noted he received
a noise nuisance complaint from Circle Pines about the air handlers on top of
the medical center. Webster stated residents have tried to talk to SCMC’s administration.
Mayor Giese indicated he would give the administrator at SCMC a call about the
noise.
