MINUTES-MORRIS CITY COUNCIL–REGULAR MEETING–OCTOBER 9, 2007

The regular meeting of the Morris City Council was called to order at 5:15 p.m. this 9th day of October, 2007, by Mayor Giese in the Council Chambers of the Morris Senior Citizens/Community Center.

PLEDGE OF ALLEGIANCE:  The Pledge of Allegiance was recited.

ROLL CALL:  Roll call was taken with the following members present:  Council members Carrington, Webster, Storck and Mayor Giese.  Council member Miller was absent.  Also present was City Manager Hill, Finance Director Krosschell, Public Works Director Dittbenner, Engineer/Surveyor/Inspector Fier, Police Chief Beauregard and City Attorney Glasrud.

READING AND APPROVAL OF MINUTES:  9/25/07 Regular Meeting Minutes:  Council member Webster moved, seconded by Storck, to approve the 9/25/07 regular meeting minutes.  Motion carried.

9/25/07 Condensed Version:  Council member Carrington moved, seconded by Webster, to approve the 9/25/07 condensed version minutes.  Motion carried.

 

AUDIT OF CITY BILLS:  Council member Webster moved, seconded by Mayor Giese, to authorize payment of the City bills dated October 9, 2007.  With all voting in favor and Council member Storck abstaining, motion carried.

Pay Estimate #11 – West 4th & 8th Streets:  Mayor Giese moved, seconded by Council member Webster, to authorize pay estimate #11 in the amount of $9,660.26 to Riley Bros. Construction for work on West 4th and 8th Streets and Alley Main Trunk Sewer.  Motion carried.

Pay Estimate #5 – West 6th and Lyndale:  Council member Carrington moved, seconded by Webster, to authorize pay estimate #5 in the amount of $48,023.98 to Riley Bros. Construction for work on West 6th Street and Lyndale Avenue. Motion carried.

CITIZEN’S COMMENTS:  None

PETITIONS, REQUESTS AND COMMUNICATIONS:  HRC Meeting Minutes:  Council member Storck moved, seconded by Webster, to accept the 9/19/07 HRC meeting minutes.  Motion carried.

Coalition of Greater MN Cities Fall Conference:  Hill noted that this is a very valuable organization to be partnered with and he would be talking about membership in the coalition during budget worksessions.  Mayor Giese indicated he would attend the conference in Alexandria and if anyone else was interested they should let city hall know.

Law Firm Changes:  City Attorney Glasrud indicated he and Deb Economou would be opening their own law firm effective January 1st and he would like to continue as the City Attorney, with Deb serving as Assistant County Attorney.  This was informational for the council at this time.

ORDINANCES AND RESOLUTIONS:  None

CITY MANAGER’S REPORTS & RECOMMENDATIONS:  Robert Wolbersen Driveway:  Hill indicated since the last meeting he has learned that Wolbersen wanted his driveway put back in because he planned to use the lot to sell things.  Hill’s stated his recommendation is the same, which is that things be left as is until such time as the property is developed.  Hill noted that the property is in an R zone, which means selling things along 5th Street is not an allowed use.  Wolbersen stated that he was given permission from Council member Storck to sell things on the property.  Storck noted he did not remember saying that and even if he did, he was probably not aware of what the area was zoned. 

Council member Webster asked if Wolbersen could apply for a variance.  Hill indicated he did not think so, and it would only be temporary because the lot is for sale.  It was noted that there are pumpkins for sale on a property and also a photography business in the area.  Hill stated home businesses are an allowed use, but in this case there is no home.  Storck asked if the driveway would be put back in when the property was sold.  Hill indicated that would have to be determined when a house is built. 

Council member Storck moved, seconded by Mayor Giese, to leave the situation as is and if access to the property is needed it be obtained through the alley.  Voting was as follows:

With all present voting in favor, motion carried.

Wolbersen stated he felt the whole situation could have been handled very easily with a phone call and he is the one getting punished. 

City Manager Report:  This was informational for the council.

NEW BUSINESS:  Schedule Worksession w/ County for 10/15/07:  Hill stated he talked with Jim Thoreen and the county is not able to meet on the 15th.  City Attorney Glasrud noted the county felt it was premature to meet with the city council but would definitely meet with them before going forward with anything on the jail issue.

OLD BUSINESS:  Council member Storck asked what became of the results from the smoke testing that was done.  Hill noted Public Works Director Dittbenner submitted a report on the testing but not much was found.  Webster asked if the report could be summarized and published and Hill indicated it could. 

Storck also asked about a plan to jet and clean the sanitary sewers.  Dittbenner noted they are on a schedule to be cleaned every three years.  Storck suggested some type of tag be put on sump pumps so they are switched over when they’re supposed to be. 

INFORMATIONAL ITEMS:  September Transit Report:  This was informational for the council.

ADJOURNMENT:  There being no further business, Mayor Giese adjourned the meeting at 5:55 p.m.
